I have a footer with a disclaimer for any Excel that I create. This created a merged cell which makes it difficult to filter. I tried putting the disclaimer on the second line and make the first line blank. It still makes the first line a merged field. How can I make the first line not merged.

Try adding this to the StyleSheet:

TYPE=FOOTING, HEADALIGN=BODY, $

I should have thought of that. While it did work for the blank line. It screws up my second line, but I think my user can deal with that.
